[Section 551.071, Government Code - Consultation With Attorney:] For a private consultation with the Board’s attorney with respect to pending or contemplated litigation or settlement offers, and/or on matters where the attorney's duty to the Board, under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the open government provisions of Chapter 551 of the Government Code, to wit:

2.A.1. Consultation with attorney regarding investigation of allegations against District employee.

2.A.2. Legal issues associated with other agenda items brought into Closed Session.

2.B. [Section 551.074, Texas Government Code - Personnel Matters:] To deliberate the, appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, to wit:

2.B.1. New Hires - Certified Administrators, for proposed assignment to fill the following position, subject to assignment and reassignment by the Superintendent:

2.B.1.a. TTIPS Grant Administrator, within Pay Grade Range AM-1 through AM-3.

2.B.2. Personnel listed in the Personnel Report under Section III (2) on the agenda.

2.B.3. Proposed finding that good cause did not exit under Section 21.105 (c)(2) of the Texas Education Code and authorization to file written complaint with the State Board of Educator Certification against the following individuals for resigning from employment and failing to perform under their written employment contracts:

2.B.3.a. Anthony "Scott" Beatty;

2.B.3.b. Ron Cardona

3.A. Action, decision, determination or vote on matters listed as closed session items.

3.B. Approval of recommendations for new hires, resignations, retirements, transfers and promotions of professional contract personnel where Board action is required. [Note: the Board does not approve transfers, resignations previously approved by the Superintendent, retirements and reassignments, notwithstanding Board action to the contrary on this item.]

3.C. Approval to accept the student code of conduct for the 2013-2014 school year.
