[Section 551.071, Government Code - Consultation With Attorney:] For a private consultation with the Board’s attorney with respect to pending or contemplated litigation or settlement offers, and/or on matters where the attorney's duty to the Board, under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the open government provisions of Chapter 551 of the Government Code, to wit:

3.A.1. E-Rate program issues;

3.A.2. General election legal issues;

3.A.3. Proposed amendments to Policy DEA (Local) [For first reading, except for the proposed immediate adoption of option for hourly employees to annualize payment of projected wages.]

3.B. [Section 551.074, Texas Government Code - Personnel Matters:] To deliberate the, appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, to wit:

3.B.1. Rescission of Board action of proposing the nonrenewal of Richard Juan Cortez;

3.B.2. Administrative New Hires and Reemployment:

3.B.2.a. Sylvia Reyna as a Chapter 21 Certified Administrator, for assignment up to a Pay Grade AM 8 position for up to 234 days. [Note: Ms. Reyna has been interviewed for an assignment to the position of Associated Superintendent for Curriculum & Instruction, subject to assignment and reassignment by the Superintendent];

3.B.2.b. Juan Zamora - as a non-Chapter 21 Administrator, for assignment up to a Pay Grade AM 7 position for up to 234 days. [Note: Mr. Zamora has been interviewed for an assignment to the position of Executive Director of Business Operations, subject to assignment and reassignment by the Superintendent];

3.B.2.c. Karen Hartmann - as a Chapter 21 Certified Administrator, for assignment up to a Pay Grade AM 7 position for up to 234 days. [Note: Ms. Hartmann was the subject of a reduction in force and has been interviewed for the position of Executive Director for District Operations, subject to assignment and reassignment by the Superintendent.]

3.B.3. Promotions:

3.B.3.a. Krista Hays - as a Chapter 21 Certified Administrator, for assignment up to a Pay Grade AP 6 position. [Note: Ms. Hays has been interviewed for an assignment to the position of Academic Dean];

3.B.3.b. Bertha Ortiz - as a Chapter 21 Certified Administrator, for assignment up to a Pay Grade AP 4 position for up to 202 days. [Note: Ms. Ortiz has been interviewed for an assignment to the position of ESL Specialist, subject to assignment and reassignment by the Superintendent];

3.B.3.c. Gloria Valle - as a Chapter 21 Certified Administrator, for assignment up to a Pay Grade AM 7 position for up to 234 days. [Note: Ms. Valle has been interviewed for an assignment to the position of Executive Director for Instructional Support, subject to assignment and reassignment by the Superintendent.]

4.B. Approval of promotions, transfers, new hires, resignations, retirements and re-assignments for professional contract personnel where Board Action is required.
