VI. Child Find - What does it look like?

Description:
Under IDEA and Section 504, the child find duty to refer and evaluate a child is triggered when there's sufficient "reason to suspect" or "reason to believe" on the part of the school agency that the child is a child with a disability in need of special education services (either special education and related services under the IDEA or special educational accommodations or other related services under Section 504). We will review the attached checklist of "referral red flags". When using this checklist, it is very important to remember that not one of these triggers alone (or even several together) would necessarily be sufficient to trigger the child find duty to refer a student for an evaluation under IDEA or Section 504. However, the more of them that exist in a particular situation, the more likely it is that the duty to evaluate has been triggered. This is not an all-inclusive list.

VII. Child Count

Description:
Child Count is an unduplicated count of all children with disabilities ages 3 - 21 receiving special education and related services according to an individualized education program (IEP) on December 1st of each year. The Special Education Leadership team will be working with each MARSS Coordinator to complete the reporting.

X. OSEP Letter to State Director's of Special Education

Description:
In a letter to state directors of special education on Tuesday, the U.S. Office of Special Education Programs emphasized that federal special education law requires elementary, middle and high school special education teachers to hold a bachelor’s degree and be fully certified to teach special education.
Special education teachers and related services personnel may not have their certification or license requirements waived on an emergency, temporary or provisional basis, the letter said. Teachers participating in alternate routes to obtain a special education certificate must follow certain requirements to be in compliance with federal rules.
