II. Policy 491 Mandatory COVID-19 Vaccination or Testing and Face Coverings Policy

Description:
The Occupational Safety and Health Administration (OSHA) Emergency Temporary Standard (ETS) is currently before the U.S. Supreme Court, which will hear oral arguments on Friday, January 7, 2022. This fast-track approach may lead to a quick ruling: MSBA will monitor the arguments on January 7 and will reach out to school districts as soon as a decision is handed down.
Minnesota OSHA (MNOSHA) Role MNOSHA plays a significant role in the state’s implementation of OSHA regulations. On December 21, 2021, MNOSHA reported on its plans to adopt the ETS as early as January 3, 2022. In light of the Supreme Court scheduled hearing, MNOSHA stated that it will not issue citations for noncompliance with any ETS requirements before January 10, 2022. In addition, MNOSHA will not issue citations for noncompliance with the standard's testing requirements before February 9, 2022, so long as an employer is exercising reasonable, good faith efforts to comply. If the Supreme Court upholds the OSHA ETS, employers with 100 or more employees need to adopt a vaccination or vaccination and testing policy on or before January 10, 2022. If needed, the Board will consider the attached policy for adoption.

III. Continuing Coverage Issues at RBEC and Possible Calendar Adjustments

In December, the board increased the rate of pay for substitute teachers. Even with this action, we are continuing to have coverage concerns. In the first three days following the Winter Break, 20% of the RBEC staff were out. On Monday, January 3rd, 27% of the RBEC staff were out; on Tuesday, January 4th; and 27% of the staff were out on Wednesday, January 5th. On those same three days, we were only able to get one outside substitute. The remaining coverage is through combining classes and teachers who are present giving up their prep time to cover.
Districts are required to have 1020 hours of instruction per year. The GCED calendar has an additional twelve instructional days over this minimum requirement. The Board already reduced two student days prior to Winter Break. Staff still worked on those days. I am recommending that the Board approve the following calendar changes:
