4. EXECUTIVE SESSION may be called for the purposes authorized by the Texas Open Meeting Act, Texas Government Code Section 551.001 et seq. concerning any and all purposes permitted by the Act, including but not limited to the following sections and purposes;

4.A.II. On a matter in which the duty of the attorney to the governmental body, under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflicts with this chapter;

4.A.III. Consider legal advice regarding personnel including ongoing employee investigations and related actions;

4.A.IV. Consider legal advice regarding items specifically listed on the agenda.

4.A.V. Consider legal advice regarding suspension without pay pending discharge, and proposed termination or proposed nonrenewal of Jeff Kemmerling's employment contract and related actions

4.B. 551.074 For the purpose of considering the appointment, employment, resignation, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee

4.B.I. Consider hiring of professional personnel;

4.B.II. Consider personnel issues including ongoing employee investigations and related actions.
