The Board reserves the right, within the constraints of State Law, to recess an open meeting into executive session. Such sessions will be announced by the President and approved by a majority of the Board for discussion of the following subjects as permitted by law:
1) Matters of immediate knowledge which would clearly have an adverse effect upon the finances of the District and Borough;
2) Subjects that tend to prejudice the reputation and character of any person, provided the person may request a public discussion;
3) Matters which by law, municipal charter, or ordinance are required to be confidential;
4) Matters, involving consideration of government records that by law are not subject to public disclosure; and
5) Purposes of Attorney/Client communications with the District's attorney; including giving direction to the District's attorney.

The matters listed above include problems pertaining to individual students and individual employees, staff negotiations, pending or potential litigation. However, the mere discussion or persons or finances will not be the cause for an executive session.
