I.D.1) Career & Technical Education: The Career Development Services Team will share an overall picture of services offered to Eaton County K-12 students. In addition, it will provide examples of individual services particular to each local district. Two alumni will showcase how their CTE experiences have helped them in their current careers.
I.D.2) Eaton RESA Strategic Plan Progress Update: The Superintendent will provide the Board with a progress update on efforts underway to renew and revise the District’s Strategic Plan for 2021-2026. Compiled stakeholder feedback and data collected from focus groups, surveys and a recent Strategic Plan Steering Committee meeting will be shared along with next steps in the renewal process.

I.D.3) Eaton RESA Extended COVID-19 Learning Plan: The Superintendent and cabinet members will provide the Board with an update on implementation of the current Eaton RESA Extended COVID-19 Learning Plan and two-way interaction data between staff and students. Reconfirmation of this plan is required under Public Act 149, Section 98a by the Board on a monthly basis, to determine continuation of or modifications to implementation of pandemic learning during the 2020-21 school year.

I.F.2) Extended COVID-19 Learning Plan Reconfirmation: Based on the Extended COVID-19 Learning Plan Reconfirmation Data Report as required by Public Act 149, Section 98a, the Superintendent is recommending that the Board approve the continuation of the current hybrid instructional delivery models for Meadowview School, GSRP classrooms, Early On and CTE programs as outlined in the Extended COVID-19 Learning Plan Revision dated January 20, 2021.

I.F.3) Contract of Employment for Superintendent: Based on completion of the annual performance evaluation and contract review for the Eaton RESA Superintendent, Cynthia Anderson, the Board President is recommending the approval of a contract in the amount of $183,031 effective July 1, 2021 – June 30, 2022.

I.F.4) MASB Board of Directors Election Ballot: MASB is requesting that each district cast one 2021 ballot for the election of candidates to serve its Board of Directors. Based on a review of the candidate information, the Board of Education will cast votes and submit one ballot for Eaton RESA.

I.F.5) 3% Healthcare Contribution Closing Agreement: The Michigan Public School Employees Retirement System Act was amended by 2010 Public Act (P.A.) 75 and 2012 P.A. 300. These P.A.s require a 3% reduction in compensation for school employees’ to be paid to the Michigan Public School Employees Retirement Services (MPSERS) Healthcare Trust. School districts have treated the contributions inconsistently as to whether they are taxable or tax exempt. School districts have also received conflicting determinations from the Internal Revenue Service (IRS) on the tax treatment of the contributions. In addition, the Office of Retirement Services (ORS) has been unsuccessful in obtaining a ruling from the IRS because the funds belong to reporting units and not to ORS.

In December 2020, ORS announced that the IRS will rule favorably on the 3% contributions to the MPSERS Healthcare Trust for districts that participate in a Closing Agreement. ORS is encouraging all districts to join the Closing Agreement regardless if a district withheld Federal and FICA taxes from the contributions. According to legal guidance received, if a district treated contributions as tax exempt and does not join the Closing Agreement, there is a possibility that the IRS could rule that contributions be treated as taxable, therefore subject to Federal and FICA withholding.

Eaton RESA has always treated these contributions as tax exempt from Federal and FICA withholding. To mitigate any future tax liability, the Executive Director of Finance & Operations and Superintendent are recommending that the Board authorize the Superintendent to: 1) accept the proposed IRS Closing Agreement, and 2) engage legal counsel from Dykema Gossett PLLC to settle the IRS dispute on behalf of Eaton RESA through executing IRS Form 2848.

I.F.6) Temporary Change to Cafeteria Plan: Per legislation signed on December 27, 2020, employers are allowed to permit carryover of unspent Flexible Spending Account funds for both medical and dependent care accounts. Carryover will be permitted for both plan years of 2020 and 2021. Steven Lowe, the attorney who handles the District’s cafeteria plan, has provided a Board Resolution and Temporary Agreement for approval so that the District can permit carryover of these funds. Tina Monroe, Executive Director of Finance & Operations, is recommending that the Board approve the resolution to adopt the Temporary Amendment and authorize the Superintendent to execute the Temporary Amendment.

I.G. Information Items
I.G.1) Extended COVID-19 Learning Plan Educational Goal Report: Based on the requirements outlined in Public Acts 149 and 165 of 2020, the District must develop and post an Extended COVID-19 Learning Plan Educational Goal Report no later than February 1, 2021. This report includes information on progress made by Meadowview students in grades K-8 from fall to mid-year, as measured through NWEA, on the educational goals set forth in the Extended COVID-19 Learning Plan last fall. The report was posted to the District’s transparency link on the website by January 29, 2021, as required by statute and is being shared with the Board.
