Semi-Annual Review of Closed Session Minutes: No less than semi-annually, a public body must meet to review minutes of all closed meetings. This can occur in closed session. At the meeting, the public body must make a determination that (1) the need for confidentiality still exists as to all or part of those minutes; and (2) that Page 15 the minutes or portions thereof no longer require confidential treatment and are available for public inspection. The determination must be reported in open session. 5 ILCS 120/2.06(d). |

Destruction of Closed Session Verbatim Recording: The verbatim record of a closed session may be destroyed without notification to or approval of a records commission or the State Archivist under the Local Records Act or State Records Act no less than 18 months after completion of the meeting, but only after (a) the public body approves the destruction of a particular recording; and (b) the public body approves the minutes of the closed session that meet the requirements of the OMA. 5 ILCS 120/2.06(c). |
