Description:
TEXAS GOVERNMENT CODE
Sec. 551.082. SCHOOL CHILDREN; SCHOOL DISTRICT EMPLOYEES; DISCIPLINARY MATTER OR COMPLAINT.
(a) This chapter does not require a school board to conduct an open meeting to deliberate in a case:
(1) involving discipline of a public school child; or (2) in which a complaint or charge is brought against an employee of the school district by another employee and the complaint or charge directly results in a need for a hearing. (b) Subsection (a) does not apply if an open hearing is requested in writing by a parent or guardian of the child or by the employee against whom the complaint or charge is brought. V.A.3. Quarterly Investment Report
Description:
Background:
Chapter 2256, Government Code Public Funds Investment Act requires the district to provide a written investment report. The report contains operating funds not required by the code at the request of the school board. The district maintains two investment pool accounts with nominal funds as a reference for comparisons only (Lone Star, and TexPool). The district uses the money market with the Commercial Bank of Texas, Emory for the bulk of its investments. Administrative Considerations: Jeff Fisher is providing the Quarterly Investment Report. Recommendation: Approve the Quarterly Investment Report, as presented. Board Action: Board approval.

V.A.4. MOU with Texas A & M University - Commerce
Description:
Background:
The District and Texas A&M University-Commerce agree to collaborate to develop and maintain Dual Credit Courses that meet the outline in the MOU. Administrative Considerations: Consider entering into a Memorandum of Understanding with Texas A&M University-Commerce for the dates as outlined in the agreement. Description:
Background:
With the recent changes at the high school, signatures need to be removed from the district's bank account. The approval can be accomplished through the Consent Agenda. V.C. Curriculum & Instruction

V.C.1. Low Attendance Waiver
Description:
Background:
The district would like to submit a Low Attendance Waiver for the Elementary campus due to health-related absences. The applicable campus is able to submit a waiver that records attendance rate that is at least 10 percentage points below the last school year's overall average attendance. Administrative Considerations: A waiver may be submitted for the following days recorded 10% less than last years attendance of "92.1%."

V.C.2. Missed Instructional Day Waiver

V.D.2. Consider and Approve the Memorandum of Understanding with The University of Texas Health Science Center at Tyler (TCHATT) Renewal
Description:
Background:
The University of Texas Health Science Center at Tyler is a Health-Related Institution member of the TCMHCC and has been funded by Senate Bill 11 to provide access to limited school- based behavioral health services via telehealth. The component of the TCMHCC for delivering school-based behavioral health services via telehealth is named TCHATT. Texas Child Health Access Through Telemedicine (TCHATT) provides telemedicine or telehealth programs to school districts to help identify and assess the behavioral health needs of children and adolescents and provide access to mental health services. Administrative Considerations: The MOU (Memorandum of Understanding) is between Rains ISD and UTHSCT (University of Texas Health Science Center at Tyler) for the 2023-24 school year. In this new version of the MOU, there is an evergreen clause that will allow the MOU to renew yearly. This MOU is to provide pediatric and adolescent behavioral health services via telehealth. Recommendation: It is the administration's recommendation that the MOU renewal be approved as presented. Board Action: Board approval |

V.E.3. Texas School Safety and Security Audit
Description:
Background:
Texas Education Code requires districts to complete safety and security audits of their facilities at least once every three years in accordance with procedures developed by the Texas School Safety Center. The process is developed as an ongoing self-assessment of a district's safety and security. Audits should be an ongoing process with the aim of identifying hazards, threats, and vulnerabilities that might pose a danger to life or property or may interfere with a safe, secure, and healthy environment that is conducive to teaching and learning. Administrative Considerations: Region 7 conducted the Texas School Safety and Security Audit for Rains ISD on April 24, 2023. Information will be shared regarding this audit. V.E.4. Interlocal Governmental Services Agreement with Rains County
Description:
Background:
This agreement is between Rains ISD and Rains County, political subdivisions of the State of Texas. In accordance with Texas Transportation Code 251.015 and Government Code Chapter 791 regarding Intergovernmental Relations, the Commissioners Court may authorize the use of the county road equipment, construction equipment, including trucks and employees necessary to operate the equipment to assist another government entity on a project if:

V.F. Set Special Meeting Date and time to Canvass May 6, 2023, Election Results
Description:
Background:
The Rains ISD General Election of School Board Trustees will be held on Saturday, May 6, 2023. The first possible date to canvass results set by the Secretary of State is Tuesday, May 9, 2023. With this date being after our regularly scheduled board meeting, a special board meeting date must be set by the Board. Administrative Considerations: Typically, the canvass may be conducted at the meeting following the election, depending on the date of the election and our meeting dates. There are factors that could delay the canvass, which would require a special meeting. They are:
Recommendation: Set the date for a special meeting to be held before Wednesday, May 17, 2023, for the purpose of canvassing the May 6, 2023, Rains ISD General Election of School Board Trustees results. Board Action: Board approval. |
