III.A. Personnel, Texas Government Code § 551.074
Description:
TEXAS GOVERNMENT CODE 6. Section 551.074. Personnel MattersSection 551.074 authorizes certain deliberations about officers and employees of the governmental body to be held in executive session: (a) This chapter does not require a governmental body to conduct an open meeting: (1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; or (2) to hear a complaint or charge against an officer or employee. (b) Subsection (a) does not apply if the officer or employee who is the subject of the deliberation or hearing requests a public hearing.267 This section permits executive session deliberations concerning an individual officer or employee. Deliberations about a class of employees, however, must be held in an open session.268 For example, when a governmental body discusses salary scales without referring to a specific employee, it must meet in an open session.269 The closed meetings authorized by section 551.074 may deal only with officers and employees of a governmental body; closed deliberations about the selection of an independent contractor are not authorized.270 Section 551.074 authorizes the public officer or employee under consideration to request a public hearing.271 In Bowen v. Calallen Independent School District,272 a teacher requested a public hearing concerning nonrenewal of his contract but did not object when the school board moved to go into executive session. The court concluded that the school board did not violate the Act.273 Similarly, in James v. Hitchcock Independent School District,274 a school librarian requested an open meeting on the school district’s unilateral modification of her contract. The court stated that refusal of the request for a hearing before the school board "is permissible only where the teacher does not object to its denial."275 However, silence may not be deemed a waiver if the employee has no opportunity to object.276 When a board heard the employee’s complaint, moved on to other topics, and then convened an executive session to discuss the employee after he left, the court found that the employee had not had an opportunity to object.277 263 TEX. Sec. 551.082. SCHOOL CHILDREN; SCHOOL DISTRICT EMPLOYEES; DISCIPLINARY MATTER OR COMPLAINT. (a) This chapter does not require a school board to conduct an open meeting to deliberate in a case: (1) involving discipline of a public school child; or
(2) in which a complaint or charge is brought against an employee of the school district by another employee and the complaint or charge directly results in a need for a hearing.
(b) Subsection (a) does not apply if an open hearing is requested in writing by a parent or guardian of the child or by the employee against whom the complaint or charge is brought.

Background:
Pursuant to the authority granted by Article 791.011 Interlocal Cooperation Act as amended desires to participate in described purchasing programs of the Regional Purchasing Cooperative. Administrative Considerations: Rains ISD is of the opinion that participation in these programs will be highly beneficial to the taxpayers of the district through the anticipated savings to be realized. Rains ISD does request that the Regional Purchasing Cooperative purchasing program include its stated need for all categories on the Regional Purchasing Cooperative Program annual contracts and Jennifer Johnson is authorized and directed to sign and deliver all necessary requests and other documents in connection therewith for and on behalf of Rains ISD. IV.C.3. Consider and Approve the 180 Degree Education Curriculum for students in grades 7-12 recommended by the Rains ISD Student Health Advisory Council (SHAC).
Description:
Background:
With new guidance regarding the Student Health Advisory Council (SHAC), the Board must select the district's Human Sexuality instruction per Texas Education Code 28.004 and the RISD Policy EHAA (LEGAL) based on the recommendation of the SHAC. The SHAC which is composed of district staff, community members, and parents recommended 180 Degree Education, at their May 12th & May 19, 2022, Public Meetings. 180 Degree Education complies with EHAA (LEGAL) content of Human Sexuality Instruction. Administrative Concerns: Recommendation: The recommendation is that the Rains ISD Board of Trustees approve the 180 Degree Education Curriculum for students in grades 7-12 as recommended by the Rains ISD Student Health Advisory Council (SHAC), and as recommended by Rachel Bounds, Director of Curriculum and Instruction. V.A. Position/Title Change - Director of Curriculum and Instruction - Change to Assistant Superintendent of Curriculum/Instruction
Description:
Background:
The position of Director of Curriculum and Instruction has currently been filled by Rachel Bounds. Previously, the position was filled with an employee that held a Superintendent Certification. Therefore, that position was changed to Assistant Superintendent of Curriculum and Instruction. Administrative Considerations: Ms. Bounds was working on her Superintendent Certification when was first assigned to this position. She has now successfully completed that certification. Recommendation: It is recommended that this position reverts to the title of Assistant Superintendent of Curriculum and Instruction. Board Action: Board approval. |
V.B. Position/Title Change - Director of Federal Programs/Accountability & PEIMS - Change to Director of Student Services
Description:
Background:
In efforts to consolidate the title for the position of Director of Federal Programs/Accountability & PEIMS held by Holly Wasson, the administration is requesting that the title be changed to Director of Student Services. Administrative Considerations: Once Mrs. Wasson completes and obtains the Superintendent Certification, the administration will request that the Board change her title to Assistant Superintendent of Student Services. Recommendation: It is recommended the title for the position of Director of Federal Programs/Accountability & PEIMS be changed to Director of Student Services. Board Action: Board approval. |
