3.C. Google Workspace NDPA (Information Item)

Description: The Utah State Board of Education recently updated the Data Privacy Agreements with Google. Each school district is required to submit an updated DPA with Google to continue the use of Google Tools in schools. The Beaver County Board of Education is being presented this information to allow comment before the DPA is signed for 2026-27.

4.G. Proposal - BHS Classroom Modulars & Beaver U Facility (Action Item)

Description: Proposal:

Classroom Modulars: Due to the life of each modular and projected enrollment declines, the modulars will be reduced from 2 modulars to 1 modular in 2028.
Security Fence for Modular Area: If code allows, the District would like to install a security fence around the modular area to limit access and improve security.
Removal of Beaver U Facility: After exploring several options, the District would like to remove this facility completely. This would require hiring a contractor to remove the facility.
Replace Beaver U with Storage Containers: Beaver High School is in need of secure storage containers to store equipment and items for various programs. The District would like to install several storage containers on the Beavre U site.
Security Fence for Beaver U Storage Site: The District is proposing the site be secured with a fence and security lighting.

4.H. Proposal - Public Sale of Harris-Willis B Water Shares (Action Item)

Russell,

I’m following up on the question about whether there are any legal prohibitions which would prevent the District from disposing of water company shares that the District previously obtained in connection with purchase of property for an elementary school but which the District has not made use of and does not intend to make use of. While the District would need to comply with any restrictions or procedures on transferring shares in the water company that are established by the water company, I am not aware of any restrictions which would apply to the District as a governmental entity to prevent disposing of the shares.

The Surplus School District Land statutes, located in Title 53G, Chapter 4, Part 9 of the Utah Code, require school districts to give to municipalities or counties what amounts to a right of first refusal before selling certain-sized parcels of land. However, those requirements specifically apply to land. Water shares are not land or some other interest in land and therefore are not real property, so these requirements do not apply.

Similarly, the Legislature in the 2026 session enacted additional statutes relating to disposal of public property which apply to school districts and to other governmental entities. However, as with the surplus land statutes which specifically apply to school districts, these statutes specifically define "public property" as "real property owned by a local governmental entity." (See Utah Code 11-1-201(4).) As a result, the processes and requirements which are established in those statutes do not apply to disposition of water shares.

School districts, as governmental entities, have a general responsibility to make good use of property they own, so the District should make efforts to obtain a fair price for the shares and should not give them away for no consideration, but apart from that can proceed with disposition of the shares without needing to satisfy any particular requirements applicable to governmental entities.
