Description:
Persons in attendance at the meeting may request a card to be completed and submitted to the Board President no later than five (5) minutes prior to the meeting. This provides the individual with an opportunity to address the Board on any subject except personnel. Public participation is limited to this portiuon of the meeting and the audience may not enter into discussion of debate matters being considered by the Board at any other time during the meeting. The Board will allot up to thirty (30) minutes for this portion of the agenda with no presentations to exceed five (5) minutes.

9. Consider the approval and adoption of an order authorizing the Board of Trustees of the Peaster Independent School District to call a bond election to be held within said District; making provisions for the conduct and the giving of notice of the election; and providing for any other provisions related thereto

10. Consider and possible action to approve a resolution retaining the law firms of Haynes & Boone, LLP (“HB”) and Powell Law Group, LLP (“PLG”) (formerly Powell, Youngblood & Taylor ,LLP) (collectively, “Co-Bond Counsel”) to provide specialized legal services in connection with the issuance of public securities by the District; Finding that PLG and HB are competent and experienced in handling such issuances of public securities, having handled such matters for more than a decade in the State of Texas; finding that: (i) such legal services require specialized expertise and experience in state and federal laws governing the issuance of public securities and therefore cannot be adequately performed by the attorneys and supporting personnel of the District; (ii) such legal services cannot be reasonably obtained from attorneys in private practice under a contract providing for the payment of hourly fees without contingency because the District will not be obligated to pay any legal fees unless the public securities are approved and actually issued; and (iii) entering into a contingent fee contract with PLG and HB to serve as Co-Bond Counsel is in the best interests of the residents of the District because PLG and HB will only be paid in the event that the public securities are actually issued; and all matters related thereto

Description:
Pursuant to Texas Government Code Sections §551.071, to consult with the District's attorney, in person or by phone, on a matter in which the duty of the attorney to the District under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with
Chapter 551 of the Texas Local Government Code. Pursuant to Texas Government Code Sections §551.074 for the purpose of considering the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer, employee, or to hear complaints or charges against a public officer or employee. |
