6.B. Face Covering Policy
Presenter:  Executive Director
Description:  Item for discussion relates to first sentence "In accordance with state law and public health guidance, . ."

Some have contended that the face coverings are not state law.
Per our legal counsel -- "
An executive order has the force of law just as a statute or court order.  See Minn. Stat. § 12.32 ("Orders and rules promulgated by the governor * * * , when approved by the Executive Council and filed in the Office of the Secretary of State, have, during a * * * peacetime emergency, * * * the full force and effect of law.")  Thus, unless a court rules otherwise, the Governor’s Executive Orders have the force of law, and I do not think any change is necessary.  That said, if you want to revise, you could state "In accordance with Executive Order 20-81 and public * * * ."

Our authorizer suggests maintaining the language as well.

We could say "mandate", but since we are a public school, the enforceablity would be the same as "law".

Also we VI.E -- regarding logos, messaging, etc.  Like our uniform policy and non-uniform day we are seeking modesty, avoiding disruption in the learning environment, etc.
