3. CLOSED MEETING (TEXAS GOVERNMENT CODE 551)

3.A. Pursuant to Texas Government Code Sections 551.071, to consult with the District's attorney, in person or by phone, on a matter in which the duty of the attorney to the District under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Texas Government Code, including the consultation with the Board's attorney regarding legal and procedural issues related to the Level III grievance.

3.B. Pursuant to Texas Government Code Section 551.074, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, including the conduct of a hearing for a Level III complaint against a District officer or employee and deliberations concerning the complaint.

4. DECLARE CLOSED MEETING ENDED AND RECONVENE IN OPEN MEETING

5. CONSIDERATION AND POSSIBLE ACTION REGARDING LEVEL III GRIEVANCE HEARING
|
|
5.A. Conduct a Level III grievance hearing filed by employee per DGBA (LEGAL and LOCAL) in open session as requested by grievant and consider action on same.
|
|
5.B. At any time the Board so determines is applicable under the Texas Open Meetings Act, the hearing may be called into closed session based on the reasons stated.
|
|
