3.B.1. Second Reading Board Policies - The Board of Directors at their December 21, 2010 Board meeting requested Board Policy GCBD - Leaves and Absences be returned for second reading on the Action Agenda. Cabinet Director Schwartz and General Counsel Turner were asked to review language to assure alignment with collective bargaining agreements and state statutes. New language has been highlighted in grey for easy reference.

3.B.2. First Reading of Board Policies (Goal #6) A notice of intent to present for review the following policies was shared with the Board at their December 21, 2010 Board meeting. Editorial changes and proposed language changes by Cabinet, Board, and OSBA have been incorporated into the following policies and are presented for first reading.

3.B.2.a. Required Language Changes - The Oregon School Boards Association has notified all ESDs and School Districts through the quarterly Policy Update of required language changes and/or citings of new legal references based on state and/or federal law changes. The following policies were provided to the Board prior to the Board meeting with background information. Additional language changes for consideration, submitted by Board members, have been incorporated into the first reading of the policies and highlighted in yellow and grey for easy reference. Cabinet, Legal Services, and Administration recommends approval of the required changes to align with current practices.

3.B.2.a.1. Resolution 11-05 Board PolicyJFCF - Hazing/Harassment/Intimidation/
Bullying/Menacing-Students - Required Background: The passage of House Bill 2599 required specific provisions for students. JFCF/GBNA were combined policies and are now separated into two individual policies; one for students, one for staff.

3.B.2.a.2. Resolution 11-06 Board Policy JFCM - Threats of Violence** - NEW - Required
Background: The US Department of Education (USDOE) amended the Family Educational Rights and Privacy Act (FERPA). The amendments that affect policy and administrative regulation specifically exclude SSN or student ID from inclusion in directory information; expand the definition of school officials to include contractor, consultant, and volunteer "acting for" the school; require the ESD to use reasonable methods to identify and authenticate the identity of parent, school official or other party before releasing confidential education records; and, in the event of a health or safety emergency or threat, permit the ESD to make decisions regarding disclosure of confidential education records. If there is a rational basis for the decision to release, the USDOE will not substitute its judgement.

Background: The State Board of Education revised OAR 581-021-0037 addressing the administering of prescription and nonprescription medication to students. The revision redefines "physician" to include only those licensed by the state of Oregon, defines "qualified trainers" and revises training and licensing language. Best practices are included for parent signature on protocols and designated staff training for medication disposal (i.e., needles and glass.)
