3.B.1. Third Reading Board Policies - The Board of Directors at their October 19, 2010 Board meeting requested additional language changes to Board Policy BD/BDA that would also impact Board Policy BCE. The Board requested both policies be returned for third reading.

3.B.2. First Reading of Board Policies (Goal #6) A notice of intent to present for review the following policies at the November 16, 2010 Board meeting was shared with the Board at their October 19, 2010 Board meeting. Editorial changes and proposed language changes by Cabinet, Board, and OSBA have been incorporated into the following policies and are presented for First Reading.

3.B.2.a. Required Language Changes - Special Education Parents Unilateral Revoking Consent - The Department of Education released IDEA Final Rule 34 C.F. R. Part 300, which significantly impacts policy, became effective December 31, 2008. Parents of students receiving special education and related services can unilaterally revoke consent. The revoked consent must be in writing and the ESD must send the parent a written notice before ceasing services. The ESD will not be in violation of the requirment to make FAPE available because of failure to provide services to a student with a revoked consent.

3.B.2.b. Required Policy - ESD's that have schools as part of their ESD programs are required to follow statutes related to the Oregon Talented and Gifted Educaiton Act. Five individual policies were recommended by OSBA. After review by Cabinet, Legal and Administration, it is their recommendation to combine all five proposed new policy into one policy to reduce redundancy.
