4. Public Forum/Comments to the Board. For Board Meetings, the Board will hear public comments regarding agenda items only. (limit 5 minutes each or 30 minutes total)

5. Executive Session as authorized by Government Code, Chapter 551, Subchapters D and E:

5.A. LEGAL COUNSEL: To consult with its attorney when the Board seeks advice about pending or contemplated litigation or a settlement offer, or when the attorney will have an ethical duty of confidentiality. (Tex. Gov't Code 551.071).

5.A.1. To receive legal advice regarding US Trinity Holdings, LLC v. Argyle Independent School District in Cause No. 26-10586-442 pending in the 442^nd District Court of Denton Texas.

5.A.2. Receive legal advice regarding development and construction of a middle school that may be constructed at 442 West Harpole Road including access to the site and the permitting and development process through the city of Argyle, Texas.

5.A.3. To consult with legal counsel regarding organization of board officers

5.A.4. To consult with legal counsel regarding next steps to fill vacant trustee positions

5.A.5. To consult with legal counsel regarding next steps for the superintendent position

5.B. PERSONNEL MATTERS & PUBLIC OFFICERS: To deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, including Board members, or to hear a complaint or charge against an officer or employee. (Tex. Gov't Code 551.074).

5.B.1. Discussion regarding selection of board officers

5.B.2. Discussion regarding filling vacant trustee positions

5.B.3. Discussion regarding next steps for the superintendent position

5.C. Pursuant to Section 551.074 of the Texas Government Code to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public office or employee, specifically; Discuss duties of Board and Superintendent regarding security.

5.D. Government Code 551.072 authorizes a governmental body to deliberate in executive session on certain matters concerning real property, including deliberations relating to the purchase or value of real property if deliberations in an open meeting would have a detrimental effect on the position of the school in negotiation with a third person.

5.E. Pursuant to Section 551.0821 of the Texas Government Code Issues Regarding a Public School Student which may reveal Personally Identifiable Information about the Student
