1. The pursuit of this matter is due to storm-related damages to West Sabine ISD's property. The desired outcome is for all covered losses to be paid in full, along with attorney's fees, by West Sabine ISD's insurance carrier in accordance with the insurance contract and state law. (Tex. Gov’t Code § 2254.1036(a)(1)(A)).
2. The law firm considered for representing West Sabine ISD specilaizes in wind and hail claims and has secured numerous favorable outcomes in large commercial property claims. The lead attorneys are licensed to practice in both federal and state courts in Texas, are in good standing with the State Bar of Texas, have each been practicing for over ten years, regularly receive recognition as highly qualified by legal publications and reviews, and are familiar with complex litigation and first-party insurance claims. In summary, the law firm under consideration appears to be well-qualified based on demonstrated competence, qualifications, and experience in the requested services. (Tex. Gov’t Code § 2254.1032. Id. § 2254.1036(a)(1)(B)).
3. The law firm has no prior contractual relationship with West Sabine ISD. West Sabine ISD first became aware of the firm through recommendations from individuals in the community and from professionals in the roofing industry who had previously worked with the firm on storm-related insurance recovery matters. Following these referrals, the District independently reviewed the firm's background, including its experience, case history, and reputation for representing public entities in similar claims. Based on this evaluation, the District determined that the firm possessed the qualifications and expertise necessary to represent West Sabine ISD. The decision to retain the firm was based solely on its demonstrated reputation and experience in comparable matters. (Id. §?2254.1036(a)(1)(C)).
4. The legal services required involve specialized insurance coverage analysis, claim adjustment disputes, and potential litigation that exceed the scope and capacity of the West Sabine ISD’s in-house legal resources. West Sabine ISD’s personnel are dedicated to ongoing operational, compliance, and governance matters and do not have the specialized experience or available time necessary to pursue complex storm-related insurance recovery litigation. (Id. § 2254.1036(a)(1)(D)).
5. The Board finds that pursuing this matter under a traditional hourly fee arrangement would require the expenditure of substantial public funds without assurance of recovery. Given the uncertainty of litigation outcomes and the significant costs associated with complex insurance disputes, securing representation on an hourly basis would place the financial risk of non-recovery on West Sabine ISD and its taxpayers. The contingent fee structure shifts that risk to the law firm and avoids the need for West Sabine ISD to commit significant upfront funds. (Id. § 2254.1036(a)(1)(E)).
6. The Board further finds that entering into a contingent fee contract is in the best interest of the residents of West Sabine ISD. The contingent structure preserves West Sabine ISD resources for educational purposes, aligns compensation with successful recovery, and ensures that West Sabine ISD incurs legal fees only if funds are recovered. This arrangement protects public funds while allowing West Sabine ISD to pursue amounts it believes are owed under its insurance policy. West Sabine ISD believes the firm's contingency fee rate is a fair and reasonable price. (Id. § 2254.1036(a)(1)(F)).
