XIV. Closed Session
Description:
(The Board of Education may convene into closed session to discuss confidential matters, and may take action upon reconvening into open session only during regular or special board meetings. No action can be taken on a specific agenda item unless it has been posted on that particular agenda. The Board is permitted to discuss various items in closed session, including but not limited to: collective bargaining, pending or imminent litigation, sale/purchase/lease of property, student discipline, and the appointment, employment compensation, discipline, performance, dismissal of specific employees. The motion to convene into closed session will state the specific reason(s).
Motion to Convene Into Closed Session * (The Board will move to convene into closed session to discuss a specific item(s) that are listed below. These are anticipated discussion items during closed session. Prior to convening into closed session, the Board may add an item(s) for discussion as part of the motion, but action will be taken only on the item(s) stated on the posted agenda.) Reason 1. The appointment, employment, compensation, discipline, performance, or dismissal of a Specific employee(s), specific independent contractors, specific volunteers, or District legal counsel; however, a meeting to consider an increase in compensation to a specific employee of a public body that is subject to the Local Government Wage Increase Transparency Act may not be closed and shall be open to the public and posted and held in accordance with [the Open Meetings Act]. 5 ILCS 120/2c)(1), amended by P.A. 101-459. Reason 2. Student disciplinary cases. 5 ILCS 120/2(c)(9). Minutes of meetings held for this reason shall never be released to protect the individual student’s privacy. Reason 3. Discussion of minutes of meetings lawfully closed under this Act, whether for purposes of approval by the body of the minutes or semi-annual review of the minutes as mandated by Section 2.06. Reason 4. Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting. |
